BATIRAM Cloud Kitchen - Terms of Service

Welcome to BATIRAM. By accessing our platform or placing an order, you agree to be bound by the following Terms of Service.

1. Account & Eligibility

· You must be at least 18 years old to create an account and place an order, forming a legally binding contract.

· You are responsible for maintaining the confidentiality of your account information and for all activities under your account.

· You must provide accurate and complete contact and delivery details.

2. Ordering, Pricing & Payment

· Contract: An order constitutes a contract for sale only once accepted by BATIRAM.

· Pricing: All prices are subject to change without prior notice. The final price, including taxes and delivery charges, is displayed at checkout.

· Payment: We accept orders through our integrated delivery partners (Swiggy, Zepto, etc.). For direct deliveries arranged via Porter, full upfront payment is required. Counter orders are accepted via UPI only.

3. Order Acceptance & Cancellation

· BATIRAM reserves the right to refuse or cancel any order at its sole discretion, including orders listed at an incorrect price.

· Cancellation: Orders cannot be cancelled once confirmed and accepted by our kitchen.

4. Delivery

· Timing: Estimated delivery times are provided by our partners and may vary due to traffic, weather, or other factors. BATIRAM is not liable for delays beyond its reasonable control.

· Risk & Responsibility: The risk of loss or damage to the food passes to you upon delivery to the carrier or upon your failure to accept delivery. You must ensure someone is available to receive the order and provide clear delivery instructions. If delivery fails due to your omission, the order will be deemed delivered, and no refund will be issued.

· Third-Party Partners: BATIRAM is not liable for the actions, omissions, or delays of third-party delivery partners.

5. Food Quality, Returns & Refunds

· Quality Assurance: Our liability for food quality issues is limited to the value of the affected item. We are not liable for any indirect or consequential losses. Responsibility for the food ends upon successful delivery.

· Refunds: Full refunds may be issued for significant issues such as damaged, burnt, or incorrect food, or order unavailability. Proof (like a photograph) may be required.

· Reporting Issues: Claims for pilferage, leakage, or tampering must be reported within 15 minutes of receiving the order from the delivery partner.

6. Offers & Promotions

· Offers are subject to location, validity periods, and specific terms. You are responsible for reviewing these terms before use.

· Offers cannot be combined with other promotions, discounts (including partner-side discounts like credit card promotions), or vouchers unless explicitly stated.

· BATIRAM reserves the right to void, modify, or discontinue any offer at any time without prior notice.

7. Third-Party Links & Content

· Our platform may contain links to third-party websites. These sites have their own terms and privacy policies, and we are not responsible for their content or practices.

· We reserve the right to disable any third-party links on our platform.

8. General Provisions

· Governing Law: These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Nashik, Maharashtra.

· Amendments: We may modify these Terms at any time by posting updates on our platform. Your continued use after changes constitutes acceptance. You are responsible for reviewing the Terms periodically.

· Service Changes: We reserve the right to suspend, modify, or discontinue any service or product without prior notice.

· Indemnity: You agree to indemnify and hold BATIRAM harmless, its officers, and representatives from any claims, damages, or liabilities arising from your use of our platform or violation of these Terms.

· Liability Limitation: To the fullest extent permitted by law, BATIRAM shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of our platform, services, or these Terms.

· Privacy: Your use of our platform is also governed by our separate Privacy Policy, which details how we collect, use, and protect your data.

· Policy Integration: These Terms of Service must be read in conjunction with all other BATIRAM policies (e.g., Privacy Policy, Refund Policy). All such policies are fully integrated and applicable.

At BATIRAM, we value your privacy. This Privacy Policy explains the limited information we collect, why we collect it, and how we use it.

We do not operate a customer account system. The only personal information we directly collect is your mobile phone number, which you voluntarily provide to us for the purpose of receiving promotional updates (e.g., offers, new menu items).

2. How We Use Your Mobile Number

Your mobile number is used exclusively to send you promotional SMS messages about BATIRAM. We do not sell, rent, or share this number with third parties for their marketing purposes.

3. Order Placement via Third-Party Platforms (Swiggy, Zepto, Porter, etc.)

All customer orders are placed through third-party delivery and logistics platforms such as Swiggy, Zepto, or Porter, etc. We do not have direct access to, nor do we collect, the personal information you provide to these platforms (including but not limited to your name, full address, payment details, or account information).

The collection, use, and storage of your data by these third-party platforms are governed solely by their respective Privacy Policies. It is your responsibility to review and agree to their terms when you use their services to place an order with us.

4. Opt-Out of Promotional Messages

You can opt out of receiving promotional messages from us at any time by:

· Replying "STOP" to any SMS we send.

· Contacting us directly at batiramhospatality@gmail.com with your request.

5. Data Security

We take reasonable precautions to protect the mobile number we hold from unauthorized access or disclosure. However, please note that no method of electronic transmission or storage is 100% secure.

6. Changes to This Policy

BATIRAM Cloud Kitchen - General Disclaimer


By placing an order with BATIRAM Cloud Kitchen, you acknowledge and agree to the following:

1. Food Preparation & Allergens

· Our food is prepared in a kitchen where allergens (including nuts, dairy, gluten, soy, etc.) are present. We take precautions, but cannot guarantee that any item is completely free from allergens due to shared equipment and preparation areas.

· It is the customer’s sole responsibility to review menu ingredients and inform us of any allergies or dietary restrictions before ordering. BATIRAM shall not be liable for any allergic reactions or health issues arising from consumption.

2. Food Quality & Safety Post-Delivery

· We ensure high standards of food preparation and packaging. However, once an order is handed to the delivery partner or collected by the customer, BATIRAM is not responsible for:

 · Temperature changes or spoilage during transit.

 · Tampering, damage, or contamination after leaving our premises.

 · Failure of the customer to store or consume the food appropriately and in a timely manner.

3. Third-Party Delivery Services

· All deliveries are facilitated by third-party partners (Swiggy, Zepto, Porter, etc.). BATIRAM:

 · Is not liable for delays, incorrect delivery, lost orders, or conduct of the delivery personnel.

 · Does not control the delivery partner’s platform, pricing, or terms. Any issues related to the delivery service must be resolved directly with the respective partner.

4. Menu & Pricing

· Menu items, descriptions, images, and prices are subject to change without prior notice.

· While we strive for accuracy, occasional errors may occur. We reserve the right to correct any pricing or descriptive errors and cancel orders arising from such errors.

5. Promotional Offers

· All promotional offers, discounts, and coupons are subject to their specific terms, validity periods, and availability. BATIRAM reserves the right to modify or withdraw any offer at any time without prior notice.

6. Limitation of Liability

To the fullest extent permitted by law, BATIRAM Cloud Kitchen, its owners, and employees shall not be liable for any direct, indirect, incidental, or consequential damages (including but not limited to illness, injury, or dissatisfaction) arising from:

· Consumption of our food products.

· Acts, omissions, or errors of third-party delivery services.

· Your use of, or inability to use, our services.

7. Jurisdiction

This disclaimer shall be governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Nashik, Maharashtra.
